These terms and conditions (“Terms”) govern your participation in the Roost Bike Titanium Handlebar Upgrade Program (“Program”). By submitting an upgrade request and checking the acceptance box on the request form, you agree to be bound by these Terms.
1. Program Overview
The Program is a voluntary initiative by Roost Bike (“Roost”, “we”, “us”) to offer customers who purchased certain discontinued titanium handlebar models the opportunity to upgrade to our current higher-strength replacement handlebar at no product cost, subject to these Terms.
This Program is a proactive measure. Participation in the Program does not constitute an admission or indication that your current handlebar is defective, unsafe, or unfit for its intended purpose as described in the product’s specifications and rating.
2. Eligibility
The Program is available to customers who purchased one of the handlebar models identified in the Safety Notice published on the Roost website. Eligibility is subject to verification by Roost, which may include confirmation of your model, order records, and purchase date.
3. Shipping and Returns
- You are responsible for the cost of shipping your original handlebar to the designated Roost return site. We will provide you with the return address for the site nearest to your location (Australia, United States, or United Kingdom).
- Your replacement handlebar will be dispatched after your original handlebar has been received and verified at the return site. Roost will cover the cost of shipping the replacement handlebar to you via standard post.
- Original handlebars that have been cut to a shorter width are accepted, as this is a normal and expected modification. Handlebars that have been intentionally damaged or destroyed will not be accepted.
4. Stock Availability and Delivery
- Replacement handlebars are manufactured in limited batches. Stock availability is not guaranteed at the time of your request, and your upgrade may be placed on backorder.
- Where a replacement is on backorder, we will provide you with an estimated delivery timeline. Delivery estimates are indicative only and are not binding commitments.
- We will fulfil upgrade requests in the order they are received, subject to stock availability and shipping logistics.
5. Nature of the Upgrade
- The upgrade is provided voluntarily and at no product cost to you. It is not a product recall, and participation in this Program does not entitle you to a refund of your original purchase price.
- The replacement handlebar is a different model with different specifications to your original handlebar. While it is designed to offer increased strength, it may differ in weight, dimensions, or other characteristics from your original handlebar.
- By accepting the replacement handlebar, you acknowledge that the upgrade is provided in exchange for the return of your original handlebar and that no further compensation, credit, or refund is owed in connection with this Program.
6. Replacement Handlebar Warranty
- Your replacement handlebar is covered by the Roost Bike standard product warranty from the date you receive it, on the same terms as any new Roost handlebar purchase. Details of the warranty are available on the Roost website.
- The warranty covers defects in materials and workmanship under normal use consistent with the product’s rated capacity and intended purpose. It does not cover damage resulting from misuse, modification, improper installation, accident, neglect, or use beyond the product’s rated capacity.
7. Assumption of Risk and Intended Use
- Mountain biking is an inherently dangerous activity that carries a risk of serious injury or death, regardless of the equipment used. By participating in mountain biking and using Roost products, you acknowledge and voluntarily accept these inherent risks.
- Roost titanium handlebars are manufactured to ISO 4210 standards and are intended for use in cross-country, trail riding, and bikepacking. They are not rated or intended for use in extreme bike park, downhill, freeride, dirt jumping, or other high-impact disciplines. Using any handlebar — including the replacement handlebar provided under this Program — beyond its rated capacity increases the risk of product failure and injury.
- You are responsible for ensuring that any handlebar you use is appropriate for your riding style and discipline, and for regularly inspecting your equipment in accordance with the guidance provided in the Roost Safety Notice and manufacturer recommendations.
- Component failures can occur during the normal course of mountain biking, including through fatigue, impact, environmental factors, and the cumulative stresses of riding. You acknowledge that no bicycle component is indestructible and that failure may occur even with proper use and maintenance.
8. Limitation of Liability
- To the maximum extent permitted by law, Roost’s liability under this Program is limited to the provision of the replacement handlebar as described in these Terms.
- Participation in this Program does not constitute an admission of liability, fault, or defect on the part of Roost in respect of any product, and nothing in this Program should be construed as such.
- Roost is not liable for any loss, damage, injury, or expense arising from the use of any handlebar — whether the original or the replacement — beyond its rated capacity or intended purpose.
9. Privacy
Personal information collected through the upgrade request form will be used solely for the purposes of administering this Program, including verifying eligibility, arranging shipping, and communicating with you about your upgrade. We will not share your personal information with third parties except as required to fulfil your upgrade (for example, shipping providers) or as required by law.
10. General
- Roost reserves the right to modify, suspend, or discontinue this Program at any time, with or without notice. Any modifications will not affect upgrade requests that have already been confirmed by Roost.
- These Terms are governed by the laws of the State of Victoria, Australia.
- If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
